A court in Kabarnet was on Thursday told how a victim of assault was stabbed by her brother-in-law for rejecting his sexual advances.
Testifying before Kabarnet Resident Magistrate, Viennah Amboko, Peris Chemaiya narrated to the court that the brother of her husband had been making sexual advances to her and was irked by her constant rejection to the point of stabbing her.
She was testifying in a case in which Victor Kemboi Chemelil, her brother-in-law is charged with assault and causing bodily harm contrary to section 251 of the penal code.

The charge sheet stated that on 12th October 2020 at around 5 pm, the accused went to his sister in-law’s home in Kapchepkor village in Baringo North sub-county, where he found the complainant with her daughter, Purity Chepkor and then started beating her. He then took out a knife and stabbed her on the back of her right shoulder and fled.
“The accused has been wanting us to have an affair but I know that in our culture it’s a taboo and so I cannot do such evil,” Peris said.
Purity saw her mother bleeding profusely and immediately called a boda boda rider who then took her to Kabartonjo district hospital where she was referred to Kabarnet referral hospital where she was admitted for treatment.
She was discharged the next day and went with her daughter to Kabartonjo police station where they recorded their statements that led to the arrest of the suspect.
“He is like a father to me and I don’t understand why the accused went to the extent of doing that, even though I don’t know what the issue was, that was not a good way to solve a problem,” added Purity in her testimony before the court.

On his cross-examination, the accused denied the charges and distanced himself from sexual advances’ claims, saying he never attacked her sister-in-law.
“I did not stab her, she was going to the farm while carrying a Jembe and a Panga, we met at the road where she slipped and hurt herself,” the accused said.
The Magistrate released the accused on a cash bail of Sh. 10,000 and adjourned the hearing to February 11, 2021, where two other witnesses will testify in the case.
